Acceptable Use Policy

This Acceptable Use Policy ("AUP") governs your use of the Kompot platform and services (the "Service") provided by PASV LLC ("Company," "we," "us"). This AUP is incorporated into and supplements our Terms of Service.

Violations May Result in Account Termination

Violations of this AUP may result in immediate suspension or termination of your account without prior notice. We reserve the right to report illegal activities to law enforcement.

1. General Prohibited Uses

You may not use the Service to:

1.1 Illegal Activities

  • Violate any applicable laws, regulations, or third-party rights
  • Engage in fraud, money laundering, or other financial crimes
  • Facilitate illegal gambling or lottery schemes
  • Promote or sell illegal drugs or controlled substances
  • Engage in human trafficking or exploitation
  • Distribute illegal content, including child sexual abuse material (CSAM)

1.2 Harmful Content

  • Distribute malware, viruses, or other harmful code
  • Conduct phishing, spoofing, or other deceptive practices
  • Promote violence, terrorism, or hate speech
  • Harass, bully, or threaten others
  • Distribute content that is defamatory or violates privacy rights
  • Infringe on intellectual property rights

1.3 System Abuse

  • Attempt to gain unauthorized access to systems or accounts
  • Circumvent security measures or access controls
  • Interfere with or disrupt the Service or other users
  • Use automated systems to scrape data or overload the Service
  • Reverse engineer, decompile, or extract source code
  • Resell or redistribute the Service without authorization

2. SMS and Telephony Usage

The Service includes SMS and telephony features powered by third-party providers. Misuse of these features may violate federal and state laws with severe penalties.

2.1 Legal Requirements

You must comply with all applicable laws, including:

  • Telephone Consumer Protection Act (TCPA): Requires prior express consent before sending marketing messages or making autodialed calls
  • CAN-SPAM Act: Requires accurate headers, identification, and opt-out mechanisms for commercial messages
  • State Laws: Many states have additional requirements for telemarketing and text messages
  • CTIA Guidelines: Industry standards for commercial messaging

2.2 Consent Requirements

Before sending SMS messages, you must:

  • Obtain proper consent from recipients (express written consent for marketing)
  • Clearly disclose the nature and frequency of messages
  • Document consent with timestamp, method, and language presented
  • Maintain consent records for at least 4 years

2.3 Prohibited SMS Content

You may not send messages that:

  • Are unsolicited or spam
  • Contain false or misleading information
  • Promote illegal products or services
  • Contain phishing links or malware
  • Violate intellectual property rights
  • Are sent without proper consent
  • Do not include required disclosures

2.4 Required Message Elements

Marketing messages must include:

  • Clear identification of sender (business name)
  • Opt-out instructions (e.g., "Reply STOP to unsubscribe")
  • Help instructions (e.g., "Reply HELP for help")

2.5 Opt-Out Compliance

You must:

  • Honor opt-out requests within 10 business days
  • Process STOP requests immediately (automated)
  • Maintain suppression lists
  • Never contact individuals who have opted out

2.6 Prohibited Messaging Practices

  • SHAFT Content: Sex, Hate, Alcohol, Firearms, Tobacco (restricted or prohibited by carriers)
  • High-Risk Content: Payday loans, debt collection harassment, cryptocurrency schemes
  • Message Pumping: Artificially inflating message volumes for fraud
  • Snowshoe Spam: Spreading messages across multiple numbers to avoid detection
  • Grey Routes: Using unauthorized or terminated sender IDs

TCPA Penalties

TCPA violations can result in statutory damages of $500-$1,500 per message. Class action lawsuits frequently result in multi-million dollar settlements. You are solely responsible for compliance.

3. AI Feature Usage

The Service includes AI-powered features. Your use of AI features is subject to additional restrictions.

3.1 Prohibited AI Uses

  • Generating malware, exploits, or hacking tools
  • Creating deceptive content (deepfakes, impersonation)
  • Generating spam or automated abusive content
  • Circumventing content moderation or safety systems
  • Creating content that sexualizes minors
  • Generating content promoting violence or terrorism
  • Automated decision-making that discriminates illegally
  • Violating third-party AI provider policies

3.2 Responsible AI Use

When using AI features, you must:

  • Review AI-generated content before sending or publishing
  • Not rely on AI for medical, legal, or financial advice
  • Disclose AI-generated content where required by law or industry standards
  • Not input sensitive personal data unless necessary for the feature
  • Comply with AI provider terms (OpenAI, Anthropic, Google)

3.3 AI Limitations

You acknowledge that:

  • AI may produce inaccurate, biased, or inappropriate outputs
  • AI outputs are not guaranteed to be original or non-infringing
  • You are responsible for verifying AI-generated content
  • AI should not be used for high-stakes decisions without human review

4. Data and Content

4.1 Data Accuracy

You are responsible for ensuring that data you submit:

  • Is accurate and up-to-date
  • Does not violate third-party rights
  • Was lawfully obtained

4.2 Prohibited Content

You may not upload, store, or transmit:

  • Illegal content
  • Content that infringes intellectual property rights
  • Malicious code or files
  • Content obtained through unauthorized access
  • Sensitive personal data without appropriate safeguards

4.3 Export Controls

You may not use the Service in violation of US export control laws. You may not provide access to the Service to individuals or entities on sanctions lists.

5. Account Security

5.1 Your Responsibilities

  • Maintain strong, unique passwords
  • Enable multi-factor authentication when available
  • Not share account credentials
  • Report security incidents immediately
  • Keep contact information current

5.2 Prohibited Actions

  • Sharing accounts or credentials
  • Creating multiple accounts to circumvent limits
  • Using automated tools to access the Service (except authorized APIs)
  • Testing security without explicit written permission

6. API Usage

If you use our APIs, you must:

  • Respect rate limits and quotas
  • Implement proper error handling
  • Not circumvent authentication or authorization
  • Not use APIs to build competing services
  • Follow API documentation and best practices

7. Reporting Violations

If you become aware of any violations of this AUP, please report them to us immediately at i@kompot.ai.

Reports should include:

  • Description of the violation
  • Evidence or examples (screenshots, message content)
  • Affected parties or resources
  • Your contact information

8. Monitoring and Enforcement

8.1 Our Rights

We reserve the right to:

  • Monitor usage for compliance with this AUP
  • Investigate suspected violations
  • Remove or disable content that violates this AUP
  • Suspend or terminate accounts for violations
  • Report illegal activities to law enforcement
  • Cooperate with legal investigations

8.2 Enforcement Actions

Depending on the severity of violations, we may:

  • Warning: Issue a warning for first-time minor violations
  • Content Removal: Remove specific violating content
  • Feature Restriction: Disable specific features
  • Suspension: Temporarily suspend account access
  • Termination: Permanently terminate the account
  • Legal Action: Pursue legal remedies

8.3 Appeals

If you believe enforcement action was taken in error, you may appeal by contacting us at i@kompot.ai with:

  • Your account information
  • Description of the action taken
  • Why you believe it was in error
  • Any supporting evidence

9. Indemnification

You agree to indemnify and hold harmless Company from any claims, damages, or expenses arising from your violation of this AUP, including:

  • Legal fees and settlement costs
  • Regulatory fines and penalties
  • Third-party claims
  • Carrier fees or penalties related to messaging violations

10. Changes to This Policy

We may update this AUP to address new issues or changes in law. Material changes will be notified via email or through the Service. Continued use after changes constitutes acceptance.
